These Terms of Service ("Terms") govern your use of the website pebblevending.com (the "Site") and the services offered by Pebble Vending LLC ("Pebble," "we," "us," or "our"), a Texas limited liability company. By accessing the Site or engaging with our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site or engage with our services.
Pebble places, stocks, and operates smart vending machines at host venues and businesses in Texas. Machine placement is provided at no upfront cost to the host venue; revenue sharing and other placement-specific terms are set out in a separate written placement agreement between Pebble and the venue. Content on the Site is provided for general information and does not itself constitute an offer or a placement agreement.
Certain product lines (such as vape products) are offered only through machines placed in age-verified venues restricted to adults 21 years of age or older, with identity and age verification at the point of purchase, in accordance with applicable federal and Texas law. The Site itself does not sell or advertise age-restricted products to consumers.
By accessing or using the services of Pebble Vending LLC, including receiving SMS (text message) communications, you agree to comply with and be bound by these Terms. If you do not agree with these terms, please do not engage with our services.
By providing your consent to receive SMS communications, you acknowledge and agree to receive text messages from Pebble Vending at the phone number you provide. Consent to receive SMS messages is not a condition of purchase or of doing business with Pebble. Information obtained as part of the SMS consent process will not be shared with third parties.
Age restriction: The Pebble Vending SMS program is intended for individuals 18 years of age or older. By opting in to receive text messages, you confirm that you are at least 18 years old.
How we obtain consent: We collect two separate, independent SMS opt-ins — one for transactional/customer-care messages and one for promotional/marketing messages — and you may give either, both, or neither. Agreeing to transactional texts does not opt you in to marketing texts. Business contacts opt in to each type verbally during phone conversations with us, by written request (for example, in an email reply), or by checking the separate SMS-consent checkboxes on the contact form on our website. Consent for each type is recorded on the contact's record in our customer relationship management system before any SMS of that type is sent. We do not send cold, unsolicited SMS to people who have not opted in.

You agree not to misuse the Site — including attempting to disrupt or overburden it, submitting false or misleading information through our forms, scraping or harvesting data from it, or using it in violation of any applicable law.
The Site and its content — including the Pebble name, logo, design, text, and graphics — are the property of Pebble Vending LLC and are protected by applicable intellectual-property laws. You may not reproduce or use them without our prior written permission.
The Site is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Pebble Vending LLC will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Harris County, Texas.
We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with an updated effective date. By continuing to use the Site or engage with our services, you agree to be bound by the revised Terms.
